Attachment For Growing Generations Notice of Decision 3/2/16 Replacement The proposed project design impacts wetland B in its entirety (3,680 square feet). Replacement ratios require 2:1 wetland replacement based on MN Rule 8420.0522 Subpart 4.A.(2). This requires 7,360 square feet of wetland replacement. The applicant is proposing to use 7,360 square feet of in advance, project specific wetland credit created by the development of a compensatory wetland mitigation area north of the project site. The mitigation site was part of a replacement plan for the construction of Rosemary Way and associated utilities. The Rosemary Way construction project used 15,207 sq. feet of excess credit from the Frenchman Place Second Addition mitigation site. Construction of the Rosemary Way wetland mitigation area, resulted in an excess of 29,825 square feet of wetland credit. Per the June 27, 2014 Rosemary Way Notice of Decision, these credits are to be made available to future development of Frenchman 3rd -5`" additions. Neither the Frenchman II or Rosemary Way Wetland Credits have been certified. The Frechman II mitigation area was completed in 2012 and the first annual monitoring report was submitted in 2014 which discussed observations from the 2013 growing season. No additional monitoring or maintenance has been completed for this site since that time. The Rosemary Way wetland mitigation site was completed in 2014 and the first monitoring report was submitted in 2015, which discussed growing season observations from 2015. Additional monitoring and maintenance will be required to certify the credits from both sites. The LGU approves the Growing Generations sequencing and replacement plan submitted on January 25, 2016 with the following condition: Condition: The applicant agrees to provide the City of Hugo escrow in the amount of $10,150. This escrow may be used to purchase bank credits in the event that project specific in advance wetland credits from either the Frenchman II mitigation site or the Rosemary Way mitigation site are not certified and are therefore not available to replace wetland impacts from the development of the parcel specified in the application.
