Hugo City Council Meeting Minutes for November 18, 2013 <br />Page 7 of 12 <br />Petryk stated there were issues with the Hazardous Waste Generators License expiring in May. <br />She asked if the City could work with the County to determine what happened to his renewal <br />request and find out what the real issues are. <br />City Administrator Bryan Bear stated that staff was working together with the County on <br />inspections and the observations have been shared. The County provides education as well as <br />enforcement, and it was not likely the license would be reinstated. It was revoked due to the <br />way hazardous waste was handled, and as staff sees it, the site needs to be properly cleaned. <br />Mayor Weidt asked if there was allowance to have another operator on the site. Bear stated the <br />license was for one operator, and the SUP acknowledges there may be another operator on the <br />site but they would need to get their own license. Weidt pointed out the other operator on the <br />site is in violation. <br />Klein asked Preisler if he saw a pad were the engine was being dismantled. Preisler stated that <br />it may have been covered with dirt. Klein asked Mr. Stewart if the pad did exist, and if the <br />edges were removed from snow plowing, why they were never replaced. Stewart stated that he <br />really hasn't been operating since last winter and he wants to move the operation closer to the <br />building. He now has a giant yellow containment barrel to suck up the spills and then transports <br />it by car to the building. He wants to move the concrete slab by or into the building, and the <br />barrels were brought special from Washington County. <br />Bronk asked for more information on what he was doing with the tires and if they were still <br />stored against the building, as shown in the picture. Stewart stated they were good tires that <br />would be peeled and the tires sold and the rims recycled. Bronk pointed out there was to be 50 <br />feet around where the tires were stored. Steward stated there is usually a tire rack they have <br />them for sale on, but they haven't peeled the tires yet. He acknowledged some lead weights did <br />end up on the ground but they were being picked up. He stated that he could not control <br />everything. Bronk also asked about the maintenance of the fence. <br />Joel Koehnen, representing Norman Horton Sr. by power of attorney, said the agreement was <br />for Dan Stewart to maintain the fence and mow. He acknowledged the fence is up and then <br />down. Norm maintains the front part of the fence. Dan is supposed to cut the grass as part of <br />the lease. Norm has been paying taxes and liability insurance, and not getting rent. He said he <br />didn't like the way it looked either. <br />City Attorney Dave Snyder asked Mr. Stewart if he contested that there were 500 tires on the <br />site on Friday and if the major appliances were still there. Stewart stated they were not more <br />than 500 tires and there were no appliances anywhere. <br />Mayor Weidt stated that Mr. Stewart's job as an operator of the business is to control <br />everything, and that only happens when he has been pushed. When approached with an <br />eviction notice in 2010, he did clean up the property and a license was issued, but it has gone <br />downhill again. There has been a pattern with the current operator with constantly ignoring the <br />rules and violating the terms of the agreement. <br />Klein stated that containment areas are normally sealed with solid borders and all liquids have <br />
