Hugo City Council minutes for March 1, 2010 <br />Page 6 of 8 <br />Update on South Ethan Avenue Neighborhood Meeting <br />City Engineer Jay Kennedy and Senior Engineering Technician Steve Duff, along with Mayor <br />Fran Miron and Councilmember Becky Petryk, held a neighborhood meeting on Monday, <br />February 22, 2010 at which a number of residents were in attendance. City Engineer Jay <br />Kennedy provided Council with an update on this meeting where neighbors expressed concerns <br />about traffic speeds, connection fees, assessments and deferments. Rick Gwynn, 12277 Ethan <br />Avenue, was present and the Mayor thanked him for his leadership in going door-to-door <br />soliciting comments and questions from the residents and bringing their concerns to City staff. <br />Rick stated the meeting was beneficial to the staff and residents who received answers to those <br />questions and raised additional issues that will be address at the next meeting on April 26, 2010 <br />at 7:00 p.m. in the Oneka Room at City Hall. Council discussed the need to address the traffic <br />concerns in that area. <br />Miron made motion, Petryk seconded, to direct staff to install a speed indicator sign temporarily <br />and to work with the Sheriff's office to increase patrol in the area. <br />All Ayes. Motion carried. <br />Discussion on Approval of Revised Burning Ordinance <br />At its August 17, 2009 City Council meeting, Fire Chief Jim Compton recommended the City <br />consider adopting a formal burning ordinance. The Council had directed staff to prepare a draft <br />burning ordinance for Council consideration, and they discussed various drafts of the ordinance <br />on three separate occasions. Community Development Director presented the most recent draft <br />and explained that this ordinance could be administered with current staffing levels. The <br />proposed ordinance includes requiring permits for open burning but not when ground is snow <br />covered, establishment of fees for illegal burns based on response and administrative costs, <br />limits on recreational burning, and prohibiting burning in barrels or using turkey flyers on decks. <br />The Council discussed whether using turkey flyers and grilling on decks should be prohibited, <br />and Assistant City Attorney Christine Eid suggested adding precatory language instead. Council <br />also questioned what was allowed by Home Owner's Associations (HOA) regarding grilling on <br />decks, and they discussed prohibiting recreational fires from 2 a.m. to 6 a.m. <br />Haas made motion, Petryk seconded, to approve ORDINANCE 2010-443 AMENDING HUGO <br />CITY CODE, CHAPTER 34, FIRE PREVENTION AND PROTECTION with revisions by staff <br />removing prohibitive language regarding turkey fryers and similar activities, and adding <br />language prohibiting fires between 2 a.m. and 6 a.m. Included in this motion was direction to <br />staff to provide information on HOA's regarding burning on decks, and direction to the Fire <br />Chief to keep data on winter burning responses by the Fire Department and report back to the <br />City Council. <br />Ayes: Weidt, Klein, Haas, Petryk, Miron <br />Nays: None <br />Motion carried. <br />
