Resolution 2014-5 <br />Page 2 <br />v. The 1.76 acres (Outlot A) shall be dedicated to the City to satisfy <br />77% of the parkland dedication requirement. <br />b. Phase 2 shall include <br />i. A maximum of 165 apartment units. <br />ii. The entire length of 147' Street to Oneka Parkway shall be <br />constructed with the first layer of bituminous prior to issuance of a <br />Certificate of Occupancy for the 1st building. The developer shall <br />be responsible for 65% of the total project costs, subject to City <br />Council review and approval at the time of site plan approval. <br />iii. The entire length of the Finale Avenue realignment through the <br />project shall be constructed with the first layer of bituminous prior <br />to the issuance of a Certificate of Occupancy for the 1 st building. <br />iv. The remaining 23% to satisfy park dedication requirements shall <br />be paid. <br />5. The developer shall submit final site plans, building elevations, street improvement <br />plans, utility plans, grading and drainage plans, landscaping plans, lighting and <br />signage plans along with the required land use applications for each phase of the <br />development. <br />6. Prior to final plat approval, the developer must comply with the following conditions: <br />a. The developer must comply with all conditions outlined in the City Engineer's <br />memos dated December 12, 2013. <br />b. The developer must comply with Resolution 2014-3, for the PUD. <br />c. The developer must obtain all necessary stormwater management and WCA <br />permits from the City. <br />d. The developer shall obtain all necessary local, state, and federal permits. <br />7. Prior to the release of the final plat for recording, the developer must comply with the <br />following conditions. <br />a. All assessments shall be paid in full. <br />b. A development agreement will need to be signed and executed in a form <br />satisfactory to the City. <br />
