RESOLUTION 2014 - 6 <br />APPROVING A CONDITIONAL USE PERMIT AMENDMENT FOR TO <br />ALLOW A MOTOR VEHICLE REPAIR BUSINESS USE ON THE PROPERTY <br />LOCATED AT 15183 FREELAND AVENUE NORTH NORTH <br />WHEREAS, Randy Nugent, requested approval of a conditional use permit amendment <br />to allow a motor vehicle repair business use on the property located at 15183 Freeland <br />Avenue North, legally described as follows; <br />That part of the west half of the southeast quarter of Section 17, Township 31, Range <br />21, Hugo, Washington County, Minnesota, described as follows: Commencing at the <br />south quarter comer of said Section 17, thence north 0 degrees 36 minutes 16 seconds <br />west, assumed bearing, along the quarter section line a distance of 1321.70 feet, <br />thence north 88 degrees 55 minutes 41 seconds east a distance of 796.66 feet, thence <br />south 1 degrees 29 minutes 36 seconds east a distance of 200 feet to the point of <br />beginning of property herein to be described: thence south 1 degrees 29 minutes 36 <br />seconds east a distance of 145 feet; thence north 88 degrees 66 minutes 41 seconds <br />east a distance of 517.88 feet; thence north 0 degrees 36 minutes 27 seconds east a <br />distance of 145 feet along the east line of west half of said southeast quarter; thence <br />south 88 degrees 55 minutes 41 seconds west a distance of 520.22 feet to the point of <br />beginning. <br />WHEREAS, the Planning Commission has reviewed said conditional use permit <br />amendment at a duly called public hearing on February 13, 2014, and recommends <br />approval subject to the conditions listed in the conditional use permit. <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />conditional use permit amendment for Randy Nugent to allow a motor vehicle repair <br />business use on the property located at 15183 Freeland Avenue North with the following <br />findings: <br />1. The proposed motor vehicle repair business is consistent with the current general <br />industrial zoning classification, which is intended to encourage the development <br />of industrial parks where uses of varying types and scale of operations can be <br />located. Such businesses may include, office, distribution, light industrial, <br />warehousing, wholesaling, and repair businesses. <br />2. The use is consistent with the character of this general industrial zoning <br />classification. The City's Comprehensive Plan identifies this area as Industrial. <br />The character of the area will not change noticeably. <br />3. There is a graded berm and landscaping along the east side of the property. This <br />does provide screening and a buffer between the property and the residential <br />development to the east <br />
