RESOLUTION 2014-17 <br />APPROVING A VARIANCE TO CONSTRUCT A 1,600 SQUARE FOOT ADDITION ON <br />AN EXISTING ACCESSORY BUILDING FOR PROPERTY LOCATED 9824140TH <br />STREET NORTH <br />WHEREAS, Pat Shimota has requested a variance to construct a 1,600 square foot addition on an <br />existing accessory building for property located on 9824 1401 Street North where a maximum of <br />four accessory buildings totaling 6,420 square feet is allowed on the property legally described as: <br />(See attached) <br />WHEREAS, the Board of Zoning Adjustments and Appeals has reviewed the variance at a duly <br />called public meeting and recommended approval, and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF HUGO, MINNESOTA, that it should and hereby does approve the variance request to construct <br />a 1,600 square foot addition on an existing accessory building for property located on 9824 140* <br />Street North where a maximum of four accessory buildings totaling 6,420 square feet is allowed <br />on the property. <br />1. The requested variance is from the dimensional requirement of the ordinance and is <br />permissible by law. <br />2. The strict enforcement of the ordinance would cause undue hardship because of <br />circumstances unique to the individual property not caused by the land owner. The <br />property is unique because of the remoteness of the property and surrounding land. The <br />surrounding properties, as well as the applicant's property, have ponds, wetlands, and <br />large groups of trees. These features seclude the property and the proposed accessory <br />building. <br />3. The granting of the variance would be in keeping with the spirit and intent of the <br />ordinance. <br />4. The property cannot be put to reasonable use without the granting of the variance. <br />5. The proposed variance would not noticeably alter the character to the average person. <br />Due to the remote location of the property and the placement of the addition, the <br />proposed variance would have minimal visual impact. Surrounding parcels also have <br />accessory buildings. <br />6. Accessory structures are a permitted use in the Agricultural Zoning District. <br />7. The subject property is not within a floodplain. <br />8.
