RESOLUTION 2014-22 <br />APPROVING A VARIANCE TO CONSTRUCT AN ACCESSORY BUILDING TO BE IN <br />FRONT OF THE PRINCIPAL STRUCTURE FOR THE PROPERTY LOCATED AT <br />12150 UPPER HEATHER AVENUE NORTH. <br />WHEREAS, Thomas Windisch has requested approval of a variance from the accessory building <br />ordinance to allow an accessory building to protrude in front of a principle building for property <br />located on 12150 Upper Heather Avenue North, legally described as: <br />LOT 1, BLOCK 3, Dellwood Ridge <br />WHEREAS, the Board of Zoning Adjustments and Appeals has reviewed the variance at a duly <br />called public meeting and recommended approval, and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF HUGO, MINNESOTA, that it should and hereby does approve the variance request to <br />construct an accessory building to be in front of the principal structure for the property located at <br />12150 Upper Heather Avenue North where the ordinance states that accessory buildings shall not <br />protrude in front of the principal building, with the following findings: <br />1. The requested variance is permissible by law. <br />2. There are practical difficulties in compliance with the ordinances due to the uniqueness <br />of the property. The property is unique because it is a comer lot, the location of the <br />existing house, and the topography of the property. <br />3. The granting of the variance would be in keeping with the spirit and intent of the <br />ordinance. <br />4. The applicant is requesting to use the property in a reasonable manner. <br />5. The proposed variance would not noticeably alter the character to the average person. <br />Due to the location of the property and the placement of the addition, the proposed <br />variance would have minimal visual impact. Surrounding parcels also have accessory <br />buildings. <br />6. Accessory structures are a permitted use in the Rural Residential Zoning District. <br />7. The subject property is not within a floodplain. <br />8. The subject property is served by individual well and septic systems. <br />ADOPTED by the City Council this 14a' day of July, <br />Tom Weidt, <br />Michele Lindau, City Clerk <br />
