RESOLUTION 2014-37 <br />A RESOLUTION APPROVING DNR DAM SAFETY PROGRAM GRANT <br />AGREEMENT <br />WHEREAS, the City of Hugo, hereinafter referred to as the "Applicant", act as <br />legal sponsor for the project described in the Department of Natural Resources Dam <br />Safety Program grant application; and, <br />WHEREAS, the Applicant has the legal authority to apply for financial <br />assistance, and the institutional, managerial and financial capability to carry out the <br />project; and, <br />WHEREAS , the Applicant has not violated any federal, state, or local laws <br />pertaining to fraud, bribery, graft, kickbacks, collusion, conflict of interest or other <br />unlawful or corrupt practice; and, <br />WHEREAS, upon approval of its application by the State, the Applicant may <br />enter into an agreement with the State for the above -referenced project, and that the <br />Applicant certifies that it will comply with all applicable laws and regulations as stated in <br />the grant agreement; and, <br />WHEREAS, the Applicant has the committed funds for its share of the project <br />costs from the following sources: City stormwater funds, Rice Creek Watershed District, <br />Minnesota Department of Transportation Bridge funds; and, <br />WHEREAS, the Applicant has sufficient funds to complete the project if the <br />actual costs exceed the estimated costs; and, <br />NOW, THEREFORE, IT IS RESOLVED that Bryan Bear, City Administrator, <br />is hereby authorized to execute the Dam Safety Program grant agreement and act as the <br />Applicant's authorized agent for the purpose of administration of the grant. <br />Adopted by the City Council this 17'h day of November, 2014. <br />Tom Weidt, Mayor <br />1.101*31q <br />\--A� A"L, <br />Michele Lindau, City Clerk <br />
