.* RESOLUTION NO. 2014-38 NOTICE REGARDING A RELEASE FROM CERTAIN ACTION FOR THE PLAT OF GENERATION ACRES WHEREAS, the City of Hugo is a political subdivision, organized and existing under the laws of the State of Minnesota; and, WHEREAS, the City Council passed a Resolution (2008-40) dated September 2, 2008, and recorded with the Washington County Recorder on November 18, 2008, as Document Number 3715226, concerning the incomplete improvements for the plat of Generation Acres, Washington County, Minnesota, as legally described in Exhibit A; and, WHEREAS, Twin Cities Habitat for Humanity — Community Housing Development Organization, Inc., acquired the property by Warranty Deed dated December 30, 2013, and recorded with the Washington County Recorder on January 13, 2014, as Document Number 3977279, WHEREAS, Twin Cities Habitat for Humanity — Community Housing Development Organization, Inc., plans to complete the development and is subject to that certain Development Agreement Dated September 6, 2005, and recorded with the Washington County Recorder on September 13, 2005, as Document Number 3539138 and, WHEREAS, in accordance with Section 4 of the said Development Agreement all public improvement shall be installed by the developer at the developers expense and a financial guarantee shall be deposited with the City. WHEREAS, Twin Cities Twin Cities Habitat for Humanity — Community Housing Development Organization, Inc., has deposited a cash escrow in the amount of $99,365.00 to complete the improvements within the plat of Generation Acres; and, WHEREAS, there is no longer a default of said Development Agreement and, NOTICE IS HEREBY GIVEN by the City Council of the City of Hugo that: 1. The property described in Exhibit A is released and is not subject to Resolution 2008-40. Whereupon said resolution was declared passed and adopted this 17th day of November, 2014.
