RESOLUTION 201448 <br />APPROVING FINDINGS OF FACT DENYING VARIANCE TO FOR A SIDE <br />YARD SETBACK FOR A BUILDING AT THE PROPERTY GENERALLY <br />LOCATED NORTH OF 122ND STREET AND EAST OF INGERSOLL AVENUE <br />WHEREAS, Gordon and Kathleen Gilde have requested a variance to locate a house 10 <br />feet from the side property line where 20 feet is required by ordinance on property <br />described as follows: <br />(See Attached) <br />WHEREAS, the Board of Zoning Adjustments and Appeals has reviewed the variance at <br />a duly called public meeting, and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does deny the variance <br />requested by Gordon and Kathleen Gilde for property generally located north of 122" d <br />Street and east of Ingersoll Avenue based on the following findings: <br />1. The applicant has not identified unique circumstances to establish practical <br />difficulties in meeting the ordinance standards. <br />2. The variance would not be consistent with other homes in the neighborhood. <br />3. The spirit and intent of the ordinance would not be met because the entire length <br />of the proposed building area extends 10 feet into the required setback, reducing <br />the amount of open space intended by the ordinance. <br />ADOPTED by the City Council this 15'h day of Dec <br />ATTEST: <br />Michele Lindau, City Clerk <br />Tom Weidt, Mayor <br />
