RESOLUTION 2012-14 <br />APPROVING AN ENCROACHMENT AGREEMENT FOR BILL AND CARRIE <br />WADZINK TO ALLOW CONSTRUCTION OF A DECK AND SHED WITHIN A <br />DRAINAGE AND UTILITY EASEMENT ON THE PROPERTY LOCATED AT <br />12701 FOXHILL CIRCLE <br />WHEREAS, Bill and Carrie Wadzink, requested approval of an encroachment agreement <br />to allow construction of a deck and shed within a drainage and utility easement on the <br />property located at 12701 Foxhill Circle, legally described as follows; <br />Lot 7, Block 2, Beaver Ponds South <br />WHEREAS, the City Council has fully considered the request for the encroachment <br />agreement, with the following conditions: <br />1. Location of the shed shall be reviewed and approved by the building permit <br />prior to installation. <br />2. The shed shall be constructed and installed to building code, but shall not <br />have footings. <br />3. The shed shall not block any drainage of the property. <br />4. The shed shall meet setback requirements. <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />encroachment agreement to Bill and Carrie Wadzink to allow construction of a deck <br />within a drainage and utility easement on the property located at 12701 Foxhill Circle. <br />ADOPTED by the City Council this 18th day of June 2012 <br />ATTEST: <br />Michele Lindau, City Clerk <br />
