RESOLUTION 2012-23 <br />APPROVING A CONDITIONAL USE PERMIT AMENDMENT FOR RICK <br />BURR TO ALLOW AN EXPANSION OF A LEGAL NON -CONFORMING <br />INDUSTRIAL USE ON THE PROPERTY LOCATED AT 15587 FOREST <br />BOULEVARD NORTH <br />WHEREAS, Rick Burr, requested approval of a conditional use permit amendment to <br />allow an expansion of a legal non -conforming industrial use on the property located at <br />15587 Forest Boulevard North <br />(See attached Exhibit A) <br />WHEREAS, the Planning Commission has reviewed said conditional use permit at a duly <br />called public hearing on August 9, 2012, and recommends approval subject to the <br />conditions listed in the conditional use permit. <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />conditional use permit amendment for Rick Burr to allow an expansion of a legal non- <br />conforming industrial use on the property located at 15587 Forest Boulevard North with <br />the following findings: <br />1. The request meets spirit and intent of the ordinance which is to allow a <br />way for legal non -conforming uses to expand and continue their business <br />by reducing the impact of the use on the surrounding properties. <br />2. The impacts of the industrial legal non -conforming use to the surrounding <br />properties will continue to be reduced by limiting exterior storage on the <br />property and requiring all blasting to be conduct inside a booth. <br />3. A building permit shall be applied for and approved by the Building <br />Department for the blasting booth prior to installation. <br />4. After December 17, 2012, all sandblasting occurring on the property shall <br />be conducted indoors, or within the approved sandblasting booth. <br />ADOPTED by the City Council this 20th day of August, 2012. <br />ATTEST: <br />`A <br />�\ ��� <br />Michele Lindau, City Clerk <br />
