CITY OF HUGO <br />RESOLUTION 2012-24 <br />APPROVING A FINAL PLAT AND DEVELOPMENT AGREEMENT ON PROPERTY <br />LOCATED NORTH OF FRENCHMAN ROAD (COUNTY ROAD 8) AND WEST OF <br />EVERTON AVENUE <br />WHEREAS, Everton Investment, LLP has requested approval of a final plat for one lot <br />and two outlots on the property legally described as follows: <br />Lot 1, Block 1, Frenchman Place 2"d Addition <br />WHEREAS, the City has prepared a development agreement covering the <br />improvements related to said plat; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF HUGO, MINNESOTA, that it should and hereby does approve the request for a <br />final plat, subject to the following findings and conditions, and; <br />FURTHER, that the development agreement for said final plat be approved, and that the <br />Mayor and City Administrator be authorized to execute the development agreement on <br />behalf of the City; subject to the following conditions: <br />A Final Plat is approved to create 1 lot and 2 outlots in Frenchman Place 2nd <br />Addition, in accordance with the application and plans received on June 13, 2012 <br />and revised on July 27, 2012 and July 31, 2012, except as amended by this <br />resolution. <br />2. The Final Plat shall be subject to the Preliminary Plat approvals (Resolutions # 2008- <br />17) granted by the City Council on May 5, 2008, except as amended by this <br />resolution. <br />3. Approval is contingent upon approval of the wetland mitigation/replacement plan. <br />4. Commercial/Industrial property is exempt from park dedication. <br />5. The Everton AUAR fees for this site have been previously satisfied. No additional <br />payment is required. <br />6. Compliance with condition 7 of Resolution 2008-17 approving the preliminary plat is <br />not required for this of future phases of Frenchman Place. Each new application <br />shall be evaluated for compliance with City Code and Commercial and Industrial <br />Design Guidelines in place at the time of site plan review and approval. <br />7. Prior to the release of the final plat for recording, the developer must comply with the <br />following conditions: <br />a. The developer must comply with all conditions outlined in the City Engineer's <br />memo dated July 31, 2012. <br />
