s RESOLUTION 20114 APPROVING A MINOR SUBDIVISION FOR JIM LEROUX ON PROPERTY LOCATED GENERALY EAST OF ELMCREST AVENUE AND NORTH OF 165TH STREET WHEREAS, an application has been filed by Jim Leroux that requests approval of a minor subdivision for property located generally east of Elmcrest Avenue and north of 165`x' Street; WHEREAS, the subject property is legally described as follows: (See Attached) WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing on March 24, 2011, and recommends approval, and; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the minor subdivision for Jim Leroux, subject to the following conditions: 1. A minor subdivision is approved to allow the creation of three lots, in accordance with the plans and application received by the City on February 9, 2011. 2. Prior to recording the minor subdivision, the park dedication shall be cash -in -lieu of dedication for a total of $4,800. 3. The property is subject to the development standards of the Shoreland Overlay District and the Future Urban Service zoning district. 4. At the time the minor subdivision is recorded, the applicant shall record a staff approved driveway maintenance and easement agreement for the shared driveway. 5. Prior to issuance of any building permit: a. The applicant shall provide a grading plan that reflects the current topography and proposed grading. b. The applicant shall demonstrate that the shared driveway and proposed buildings will not impact any wetlands. c. The applicant shall demonstrate that the parcels are able to meet the Rice Creek Watershed District Rules. d. The applicant shall demonstrate the building sites will comply with the City's regulations regarding building elevation related to groundwater.
