s <br />RESOLUTION 20114 <br />APPROVING A MINOR SUBDIVISION FOR JIM LEROUX ON PROPERTY <br />LOCATED GENERALY EAST OF ELMCREST AVENUE AND NORTH OF <br />165TH STREET <br />WHEREAS, an application has been filed by Jim Leroux that requests approval of a <br />minor subdivision for property located generally east of Elmcrest Avenue and north of <br />165`x' Street; <br />WHEREAS, the subject property is legally described as follows: <br />(See Attached) <br />WHEREAS, the Planning Commission has reviewed said request at a duly called Public <br />Hearing on March 24, 2011, and recommends approval, and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the minor <br />subdivision for Jim Leroux, subject to the following conditions: <br />1. A minor subdivision is approved to allow the creation of three lots, in accordance <br />with the plans and application received by the City on February 9, 2011. <br />2. Prior to recording the minor subdivision, the park dedication shall be cash -in -lieu of <br />dedication for a total of $4,800. <br />3. The property is subject to the development standards of the Shoreland Overlay <br />District and the Future Urban Service zoning district. <br />4. At the time the minor subdivision is recorded, the applicant shall record a staff <br />approved driveway maintenance and easement agreement for the shared driveway. <br />5. Prior to issuance of any building permit: <br />a. The applicant shall provide a grading plan that reflects the current <br />topography and proposed grading. <br />b. The applicant shall demonstrate that the shared driveway and proposed <br />buildings will not impact any wetlands. <br />c. The applicant shall demonstrate that the parcels are able to meet the Rice <br />Creek Watershed District Rules. <br />d. The applicant shall demonstrate the building sites will comply with the <br />City's regulations regarding building elevation related to groundwater. <br />
