RESOLUTION 201.1-5 <br />APPROVING A CONDITIONAL USE PERMIT FOR -JIM LEROUX TO ALLOW <br />- <br />A. SHARED. DRIVEWAY FOR -THE PROPERTIES GENERALY LOCATED. <br />EAST OF ELMCREST AVENUE AND. NORTH OF 165 rH STREET <br />WHEREAS, Jim Leroux, requested approval of a conditional use permit to allow a <br />shared driveway for the properties generally located east of Elmcrest Avenue and north <br />of 165`" Street. <br />WHEREAS, the subject properties are legally described as follows: <br />(See attached Exhibit A) <br />WHEREAS, the Planning Commission has reviewed said conditional use permit at a duly <br />called public hearing on March 24, 2011, and recommends approval subject to the <br />conditions listed in the conditional use permit. <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />conditional use permit for Jim Leroux for a shared driveway, subject to the following <br />conditions: <br />1. At the time the minor subdivision is recorded, the applicant shall record a staff <br />approved driveway maintenance and easement agreement for the shared <br />driveway. <br />2. Prior the issuance of a building permit for either parcel C or B, the applicant will <br />need to demonstrate that the area of the proposed shared driveway will not impact <br />any wetlands. If wetlands are proposed to be impacted the applicant shall move <br />the location of the driveway so there would not be impact or acquire the proper <br />permits for impacting a wetland. <br />ADOPTED by the City Council on April 4, 2011. <br />tron, Mayor <br />ATTEST: <br />Michele Lindau, City Clerk <br />
