RESOLUTION 2011-29 <br />APPROVING A MINOR SUBDIVISION FOR SCOTT AND SUE KERSTEN FOR 7139 <br />165TH STREET <br />WHEREAS, an application has been filed by Scott and Sue Kersten that requests approval of a <br />minor subdivision for property located at 7139 165'h Street. <br />WHEREAS, the subject property is legally described as follows: <br />Government Lot 2, Section 9, Township 31, Range 21 West, Washington County, Minnesota <br />WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing <br />on September 8, 2011, and recommends approval, and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF HUGO, MINNESOTA, that it should and hereby does approve the minor subdivision for <br />Scott and Sue Kersten, subject to the following conditions: <br />1. A minor subdivision is approved to allow the creation of two lots, in accordance with the <br />plans and application received by the City on July 13, 2011 and August 15, 2011. <br />2. The property is subject to the development standards of the Shoreland Overlay District and <br />the Future Urban Service zoning district. <br />3. Prior to recording the minor subdivision: <br />a. The park dedication shall be cash -in -lieu of dedication for a total of $2,400. <br />b. A 33 foot wide roadway easement shall be dedicated to the City for the right-of- <br />way for Harrow Avenue. <br />c. A septic permit shall be issued by Washington County. <br />4. Prior to issuance of any building permit: <br />a. The applicant shall provide a grading plan that reflects the current topography <br />and proposed grading. <br />b. The applicant shall demonstrate that the parcels are able to meet the Rice Creek <br />Watershed District Rules. <br />c. The applicant shall demonstrate the building sites will comply with the City's <br />regulations regarding building elevation related to groundwater. <br />d.
