0 <br />RESOLUTION•NO 2011- 34 <br />A RESOLUTION RECEIVING FEASIBILITY REPORT AND CALLING FOR -THE PUBLIC HEARING <br />ON THE PROPOSED 124Th STREET NORTH, 124TH STREET COURT NORTH, IZ4TH STREET CIRCLE <br />NORTH, EUROPA AVENUE, FALCON AVENUE; FALCON COURT NORTH, GALLIVAN COURT <br />NORTH, AND 126TH STREET NORTH (LAKE AIR ESTATES/BALD EAGLE ESTATES) ROADWAY <br />AND DRAINAGE IMPROVEMENTS <br />WHEREAS, by a resolution passed by the council on October 19, 2009, the City Engineer was <br />directed to prepare a Feasibility Report related to the improvement of the following roadways <br />within Lake Air Estates and Bald Eagle Estates: <br />• 124h Street North between Europa Avenue North and Falcon Avenue North <br />• 120 Street Court North <br />• 120 Street Circle North <br />• Europa Avenue North between a point approximately 1,000 feet south of 126`" Street North, southerly to <br />the cul-de-sac. <br />• Falcon Avenue between 125"' Street North and 126`" Street North <br />• Falcon Court North from 126`" Street North to the cul-de-sac <br />• Gallivan Court North <br />• 126'h Street North between Exhall Avenue North and Falcon Avenue North <br />WHEREAS, the Feasibility Report provides information regarding whether the proposed <br />improvement is necessary, cost-effective, and feasible; whether it should best be made as proposed <br />or in connection with some other improvement; the estimated cost of the improvement as <br />recommended; and a description of the methodology used to calculate individual assessments for <br />affected parcels. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF HUGO, MINNESOTA: <br />1. The council will consider the improvement of Lake Air Estates, Drainage, and <br />Utility Improvements and the assessment of affected property for all or a portion of the cost of the <br />improvement pursuant to Minnesota Statutes, Chapter 429 at an estimated total cost of the <br />improvement of $879,800. <br />2. A hearing shall be held on the 7th day of November, 2011 at City Hall, 14669 <br />Fitzgerald Avenue North on or after 7:00 p.m. to consider the improvements and at such time and <br />place all persons owning property affected by such improvement will be given an opportunity to be <br />heard with reference to the proposed improvements. <br />3. The city clerk is hereby directed to cause a notice of the hearing on the proposed <br />project to be published twice in the official newspaper, with the second notice to be at least three <br />days prior to the hearing. The city clerk shall state in the notice the area proposed to be assessed, <br />the general nature of the improvements, and the total estimated cost of the improvement. She shall <br />also cause mailed notice to be given to the owner of each parcel in the proposed assessment area not <br />less than ten (10) days prior to the hearing. <br />Council members voting AYE: Haas, Klein, Weidt, Miron <br />Council members voting NAY: None <br />
