i� <br />R . <br />RESOLUTION 201148 <br />APPROVING A PRELIMINARY PLAT FOR XCEL ENERGY INC. FOR <br />"MOLITOR ADDITION" LOCATED SOUTH OF 140TH STREET AND WEST OF <br />FENWAY BOULEVARD NORTH <br />WHEREAS, Xcel Energy inc. has requested approval of a preliminary plat of property to <br />develop 1 lot and 2 outlots to be known as "Molitor Addition" located south of 14& <br />Street and west of Fenway Boulevard and is legally described as follows: <br />(See Attached) <br />WHEREAS, the Planning Commission has reviewed said preliminary plat and <br />recommends approval. <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />preliminary plat to Xcel Energy Inc. for "Molitor Addition" subject to the following <br />conditions: <br />1. A preliminary plat is approved to allow the creation of 1 lot and 2 outlots, in <br />accordance with the plans received by the City on November 18, 2011 except as <br />amended by this resolution. <br />2. Development is subject to the BP district standards and setbacks. No variances <br />are granted or implied. <br />3. The development shall comply with the comments in the Engineer's memo dated <br />December 1, 2011. <br />4. The applicant shall dedicate 40 feet of right of way for 1400 Street. <br />5. The applicant shall be responsible for 'h the cost of a standard City collector street <br />(140`x' Street) across the entire frontage of the property. Said funds shall be <br />deposited in an escrow account held by the City for this purpose at the time Outlot <br />A is subdivided or developed. Alternatively, the applicant may construct 140a' <br />Street as may be necessary to serve the development, subject to approval by the <br />City. The amount for %i the cost of the road construction totals $91,575. When <br />this payment is received this condition has been met. <br />6. All existing buildings shall be demolished prior to the issuance of any certificate <br />of occupancy. <br />7. Although it is not required as part of the plat, Outlot B is proposed to be donated <br />to the City. Outlot B is intended to be owned and maintained by the City. <br />8. Prior to the recording of the final plat, the Fenway Boulevard road construction <br />deferred assessment of $275,944.85 shall be paid in full. <br />
