RESOLUTION 201149 <br />APPROVING A FINAL PLAT FOR XCEL ENERGY INC. FOR "MOLITOR <br />ADDITION" LOCATED SOUTH OF 140TH STREET AND WEST OF FENWAY <br />BOULEVARD NORTH <br />WHEREAS, Xcel Energy Inc. has requested approval of a final plat to plat 1 lot and 2 <br />outlots to be known as "Molitor Addition" located south of 140' Street and west of <br />Fenway Boulevard and is legally described as follows: <br />(See Attached) <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the final <br />plat to Xcel Energy for "Molitor Addition" subject to the following conditions: <br />1. A final plat is approved to allow the creation of 1 lot and 2outlots, in accordance <br />with the plans received by the City on November 18, 2011 except as amended by <br />this resolution. <br />2. The final plat shall be subject to the preliminary plat approval granted by the City <br />Council on January 19, 2012, and as maybe amended. (Resolution # 2011-149 <br />3. Development is subject to the BP district standards and setbacks. No variances <br />are granted or implied. <br />4. The development shall comply with the comments in the Engineer's memo dated <br />December 1, 2011. <br />5. The applicant shall dedicate 40 feet of right of way for 14& Street. <br />6. With the subdivision or development of Outlot A, 140th Street shall be constructed <br />or an escrow in the amount to cover half the construction cost shall be deposited <br />with the City. <br />7. The applicant shall be responsible for %2 the cost of a standard City collector street <br />(140th Street) across the entire frontage of the property. Said funds shall be <br />deposited in an escrow account held by the City for this purpose at the time Outlot <br />A is subdivided or developed. Alternatively, the applicant may construct 140th <br />Street as may be necessary to serve the development, subject to approval by the <br />City. The amount for V2 the cost of the road construction totals $91,575. When <br />this payment is received this condition has been met. <br />8. Although it is not required as part of the plat, Outlot B is proposed to be donated <br />to the City. Outlot B is intended to be owned and maintained by the City. <br />The following conditions shall be met prior to the Final Plat being recorded: <br />9. The Fenway Boulevard road construction deferred assessment of $275,944.85 <br />shall be paid in full. <br />
