RESOLUTION 2010-16 <br />APPROVING A VARIANCE FOR SHORELAND SETBACK FOR SCOTT AND <br />MELISSA MARSTON IN THE RURAL RESIDENTIAL ZONING DISTRICT ON <br />PROPERTY LOCATED AT 8895126TH STREET NORTH <br />WHEREAS, Scott and Melissa Marston have requested approval of a variance from the <br />shoreland setback requirements to construct a building addition to be 150 feet from the <br />ordinary high water mark of Long Lake, where 200 feet is required by ordinance on <br />property described as follows: <br />LOT 7, BLOCK 2, COUNTRY VIEW ACRES <br />WHEREAS, the Board of Zoning has reviewed said variance at a duly called public <br />hearing on April 22, 2010 and recommends approval with the following conditions: <br />Prior to the issuance of a building permit: <br />1. The lowest floor of the addition shall be 4 feet above any known water table or <br />the ordinary high water mark of Long Lake, whichever is greater. <br />2. The applicant shall have approval from Washington County on the placement of a <br />new septic tank and show an area on the survey for a secondary site in case there <br />is a failure of the septic system. <br />3. The application shall have approval for the relocation of the existing well on the <br />property. The existing well shall be capped when replacement occurs. <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />variance request for Scott and Melissa Marston from the shoreland setback requirements <br />to construct a building addition on the property located at 8895 126�n Street North. <br />ADOPTED by the City Council this 3rd day of May 2010 <br />FkWron, ayor <br />ATTEST: <br />Michele Lindau, City Clerk <br />
