RESOLUTION 2010-18 <br />APPROVING A VARIANCE FOR SCOTT AND MELISSA MARSTON IN THE <br />RURAL RESIDENTIAL ZONING DISTRICT ON PROPERTY LOCATED AT <br />8895126" STREET NORTH <br />WHEREAS, Scott and Melissa Marston have requested approval of variances from the <br />side yard setback requirements to construct a garage addition 10 feet from the side yard <br />property line, where 20 feet is required by ordinance, on property described as follows: <br />LOT 7, BLOCK 2, COUNTRY VIEW ACRES <br />WHEREAS, the Board of Zoning has reviewed said variance at a duly called public <br />hearing on April 22, 2010 and recommends approval. <br />WHEREAS, the City Council has reviewed said variance on May 17, 2010 and <br />recommended approval with the following conditions. <br />1. The variance is approved for the garage addition; any other building addition shall <br />comply with the building setback requirements. <br />2. The garage addition is 19 feet wide at the 10 foot setback line. <br />Prior to the issuance of a building permit: <br />3. The lowest floor of the addition shall be 4 feet above any known water table or <br />the ordinary high water mark of Long Lake, whichever is the greater. <br />4. The applicant shall have approval from Washington County on the placement of a <br />new septic tank and show an area on the survey for a secondary site in case there <br />is a failure of the septic system. <br />5. The application shall have approval for the relocation of the existing well on the <br />property. The existing well shall be capped when replacement occurs. <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />variance request for Scott and Melissa Marston from the side yard setback requirements <br />to construct a garage addition on the property located at 8895 126th Street North. <br />ADOPTED by the City Council this 17th day of May 2010 <br />i <br />ATTEST: <br />Michele Lindau, City Clerk <br />
