RESOLUTION 2010-19 <br />APPROVING VARIANCES FOR JAKE AND PATTY GIBBS IN THE RURAL <br />RESIDENTIAL ZONING DISTRICT ON PROPERTY LOCATED AT 12465 <br />HEATHER AVENUE NORTH <br />WHEREAS, Jake and Patty Gibbs have requested approval of a variance from the <br />accessory building ordinance to allow an accessory building to protrude in front of a <br />principal building and a variance to allow a 2,498 square foot accessory building, where <br />2,000 square feet is allowed by ordinance. <br />LOT 1, BLOCK 3, Dellwood Ridge <br />WHEREAS, the Board of Zoning has reviewed said variance at a duly called public <br />hearing on May 27, 2010, and recommends approval with the following conditions: <br />Prior to the issuance of a building permit: <br />1. The lowest floor of the addition shall be 4 feet above any known water table. <br />2. Accessory buildings shall not have indoor plumbing such that it would allow the <br />structure to be used as living space, which would constitute a dwelling. <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />variance request for Jake and Patty Gibbs from the accessory building ordinance to allow <br />an accessory building to protrude in front of a principal building and a variance to allow a <br />2,498 square foot accessory building, where 2,000 square feet is allowed by ordinance. <br />ADOPTED by the City Council this 7th day of June 2010 <br />rP� <br />ATTEST: <br />"4, - <br />Michele Lindau, City Clerk <br />
