RESOLUTION 2010-38 <br />APPROVING A SITE PLAN, VARIANCE AND CONDITONAL USE PERMIT <br />AMENDMENT IN THE RESTRICTED COMMERICAL ZONING DISTRICT <br />FOR THE PROPERTY LOCATED AT 17385 FOREST BOULEVARD NORTH <br />WHEREAS, Rick Lessard has requested approval of a site plan, variance, and conditional <br />use permit amendment to allow construction of a metal storage building on the property. <br />WHEREAS, the property is legally described as: <br />See Attached <br />WHEREAS, the Planning Commission has reviewed said site plan, variance, conditional <br />use permit amendment at a duly called public hearing on August 12, 2010, and <br />recommends approval. <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve site plan, <br />variance, and conditional use permit amendment to allow construction of a metal storage <br />building on the property, with the following conditions: <br />1. The metal storage building shall be removed or improved to meet the commercial <br />and industrial construction standards within six months of sewer and water <br />becoming available to the property. <br />2. Prior to the construction of the building, a building permit shall be obtained from the <br />City. <br />3. All setback requirements shall be met. <br />4. The applicant shall screen the storage area for the benefit of the surrounding <br />properties. The screening shall remain as long as the use exists. <br />5. The storage area shall be limited to business related equipment and materials. <br />6. A maximum of 800/6 of the property shall be used for buildings, impervious <br />surface, and exterior storage. <br />7. The property shall meet all conditions in the engineer's memo dated August 6, <br />2010. <br />
