RESOLUTION NO. 2010 - 46 <br />A RESOLUTION RECEIVING FEASIBILITY REPORT AND CALLING FOR THE <br />PUBLIC HEARING ON THE PROPOSED IMPROVEMENT OF THE SOUTH ETHAN <br />AVENUE ROADWAY, DRAINAGE, AND UTILITY IMPROVEMENTS <br />WHEREAS, by a resolution passed by the council on July 6, 2010, the City Engineer was directed <br />to prepare a Feasibility Report related to the improvement of the South Ethan Avenue Roadway, <br />Drainage, and Utility Improvements. <br />WHEREAS, the Feasibility Report provides information regarding whether the proposed <br />improvement is necessary, cost-effective, and feasible; whether it should best be made as proposed <br />or in connection with some other improvement; the estimated cost of the improvement as <br />recommended; and a description of the methodology used to calculate individual assessments for <br />affected parcels. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF HUGO, MINNESOTA: <br />1. The council will consider the improvement of South Ethan Avenue Roadway, <br />Drainage, and Utility Improvements and the assessment of affected property for all or a portion of <br />the cost of the improvement pursuant to Minnesota Statutes, Chapter 429 at an estimated total cost <br />of the improvement of $1,163,186. <br />2. A hearing shall be held on the 1 st day of November, 2010 at City Hall, 14669 <br />Fitzgerald Avenue North on or after 7:00 p.m. to consider the improvements and at such time and <br />place all persons owning property affected by such improvement will be given an opportunity to be <br />heard with reference to the proposed improvements. <br />3. The city clerk is hereby directed to cause a notice of the hearing on the proposed <br />project to be published twice in the official newspaper, with the second notice to be at least three <br />days prior to the hearing. The city clerk shall state in the notice the area proposed to be assessed, <br />the general nature of the improvements, and the total estimated cost of the improvement. The City <br />Clerk shall also cause mailed notice to be given to the owner of each parcel in the proposed <br />assessment area not less than ten (10) days prior to the hearing. <br />Council members voting AYE: Klein, Petryk, Weidt, Haas, Miron <br />Council members voting NAY: None <br />Whereupon said resolution was declared passed and adopted this 4th day of October, 2010. <br />Jn, Mayor <br />ATTEST: <br />T-• <br />Michele Lindau, City Clerk <br />
