RESOLUTION 2009-24 <br />APPROVING PRELIMINARY PLAT AND FINAL PLAT FOR POAC-CRAIN, LLC. <br />FOR "VICTOR GARDENS COMMONS" ON PROPERTY LOCATED SOUTH OF <br />FRENCHMAN ROAD (COUNTY ROAD 8) AND WEST OF LEOPOLD LANE <br />WHEREAS, POAC-Crain, LLC, has requested approval of a preliminary plat and final plat to <br />allow construction of two commercial lots on the 2.23 -acre property legally described as follows: <br />Lot 1, Block 5, Victor Gardens 4th Addition <br />WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called Public <br />Hearing and recommends approval; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF HUGO, MINNESOTA, that it should and hereby does approve the request by POAC-Crain, <br />LLC for a preliminary plat and final plat, subject to the following conditions: <br />1. A preliminary plat and final plat are approved to allow the creation of two commercial lots in <br />accordance with the application and plans received by the City on June 03, 2009 and <br />revisions received on July 16, 2009, except as amended by this resolution. <br />2. The approval of the PUD General Plan is contingent on approval of the Preliminary and Final <br />Plat for Victor Gardens Commons. <br />3. The development shall be consistent with the Victor Gardens PUD concept plan approvals <br />and the Victor Garden Commons approvals. <br />4. Building architecture in the Victor Gardens Commons shall be consistent with the overall <br />Victor Gardens PUD architecture. <br />5. The developer shall obtain all necessary permits from the City. <br />6. The development shall comply with the Fire Chief s requirements regarding fire flow <br />calculations, the location of fire hydrants, fire department connections, and fire lane signage. <br />7. The developer shall comply with all conditions outlined in the City Engineer's memo dated <br />July 1, 2009. <br />8. Development Sign Criteria shall be reviewed and approved by City staff. <br />9. The monument sign shown on the plan shall be reviewed and approved by City Staff at the <br />time that Lot 2 develops. <br />10. There are no approvals for the site concept shown on Lot 2. <br />
