RESOLUTION 2008-3 <br />APPROVING AN INTERIM USE PERMIT TO ALLOW FOR THE OPERATION <br />OF A HOME OCCUPATION AS AN ACCESSORY USE, PROPERTY LOCATED <br />AT 13755 ELMCREST AVENUE NORTH <br />WHEREAS, Dennis and Ann Thompson have requested approval of an interim use <br />permit to allow for the operation of a home occupation as an accessory use on the <br />property legally described as follows: <br />(See Attached) <br />WHEREAS, the Planning Commission has reviewed the request at a duly called Public <br />Hearing on January 24, 2008 and recommended approval, and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />request by Dennis and Ann Thompson for a interim use permit to allow for the operation <br />of a home occupation as an accessory use with the following findings, subject to the <br />conditions included therein: <br />1. The applicant owns the property and resides in the principle residential <br />address associated with the home occupation. <br />2. A home occupation is allowed as an accessory use in the Single <br />Family Detached Residential zoning district. <br />3. The spirit and intent of the ordinance is to allow a way for a property <br />owner to have a home occupation with an interim use permit with <br />conditions to limit the operation of the business. The home occupation <br />shall meet the general performance standards and procedures by which <br />home occupations can be conducted without jeopardizing the health, <br />safety and general welfare of the surrounding properties. The home <br />occupation meets the spirit and intent of the ordinance. <br />4. The present character of the surrounding area is large lot single family <br />residential and Fable Hills housing development is to the south and <br />east of the property. Fable Hills 3rd Addition is planned to be directly <br />to the east of the property. The home occupation is compatible with <br />the present character of the area. <br />5. The interim use permit shall be reviewed in two years. <br />6. It does not appear that the home occupation would impose additional <br />unreasonable cost to the public. <br />7. To operate the business from the property the applicant will sign the <br />interim use permit and agree to the conditions outlined in the permit. <br />
