A <br />RESOLUTION 2008-23 <br />APPROVING FINAL PLAT AND DEVELOPMENT AGREEMENT FOR <br />FRENCHMAN PLACE 1ST ADDITION ON PROPERTY LOCATED AT THE <br />NORTHWEST QUADRANT OF EVERTON AVENUE NORTH AND <br />FRENCHMAN ROAD (COUNTY ROAD 8) <br />WHEREAS, Everton Investments, LLP has requested approval of a final plat to allow <br />construction on the 54.1 -acre property legally described as follows: <br />That part of the East Half of the Northwest Quarter of Section 19, <br />Township 31, Range 21, Washington County, Minnesota lying northerly <br />of the center line of Frenchman Road (aka County State -Aid Highway <br />(CSAH) No. 8). <br />WHEREAS, the City has prepared a development agreement covering the improvements <br />related to said plat; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />request by Everton Investments LLP. for a final plat, and; <br />FURTHER, that the development agreement for said final plat be approved, and that the <br />Mayor and City Administrator be authorized to execute the development agreement on <br />behalf of the City; subject to the following conditions: <br />1. A Final Plat is approved to allow construction on the 54.1 -acre property, in <br />accordance with the final plat graphics dated May 2, 2008, except as amended by this <br />resolution. <br />2. The Final Plat shall be subject to the Rezoning (Ord. #2008-416 & Res. #2008-14), <br />Preliminary Plat (Res. #2008-17), Site Plan (Res. #2008-16), and Variance (Res. <br />#2008-15) approvals granted by the City Council on May 5, 2008. <br />3. Prior to the release of the final plat for recording, the developer must comply with the <br />following conditions: <br />a. A development agreement shall be signed and executed in a form satisfactory to <br />the City. The development agreement shall clearly outline the timing of <br />improvements, cost and financing of improvements and responsible parties. <br />b. Park dedication will be due for Lot 1, Block 1 and Lots 1 and 2, Block 2 for the <br />first phase of the development. The developer shall pay a park dedication fee in <br />lieu of dedicating land (9.3 net acres X $2,400 = $22,320). Park dedication for <br />the remaining lots and outlots will be due with the final plat for the subsequent <br />phases. Park dedication shall be subject to the fees in place at the time of release <br />of the final plat. <br />
