10 <br />RESOLUTION 2008-25 <br />APPROVING FINDINGS OF FACT APPROVING A REZONING FOR PROPERTIES <br />LOCATED AT 14029 FOREST BOULEVARD AND 5560140TH STREET <br />WHEREAS, Mike Atkinson has requested a rezoning to change the zoning from Residential <br />Service (RS) to Central Commercial (C-1) ; and, <br />WHEREAS, the subject property is legally described as follows: <br />(SEE ATTACHED) <br />WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing <br />on May 8, 2008 and recommends approval; and <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF HUGO, MINNESOTA, that it should and hereby does approve the rezoning of the properties <br />located at 14029 Forest Boulevard and 5560 140th Street from Residential Service (RS) to <br />Central Business (C-1), based on the following findings: <br />1. The City's Comprehensive Plan identifies the subject parcels as commercial/industrial. <br />Rezoning the property central business would be in compliance with the land use guide <br />plan. <br />2. The proposed zoning classification is appropriate for the property because there is not <br />topographic, environmental, or cultural limitation of the site. <br />3. Sewer and water are available on the property. In addition, a traffic signal and intersection <br />improvements have been installed at the intersection of 140th and Highway 6. At the time <br />of site plan approval additional public improvements may be considered to approve the <br />development. <br />4. While the properties to the east are developed with single family homes, they are <br />separated from this property by a drainage way that will serve as an acceptable transition <br />to a proposed commercial development.
