10
RESOLUTION 2008-25
APPROVING FINDINGS OF FACT APPROVING A REZONING FOR PROPERTIES
LOCATED AT 14029 FOREST BOULEVARD AND 5560140TH STREET
WHEREAS, Mike Atkinson has requested a rezoning to change the zoning from Residential
Service (RS) to Central Commercial (C-1) ; and,
WHEREAS, the subject property is legally described as follows:
(SEE ATTACHED)
WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing
on May 8, 2008 and recommends approval; and
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF HUGO, MINNESOTA, that it should and hereby does approve the rezoning of the properties
located at 14029 Forest Boulevard and 5560 140th Street from Residential Service (RS) to
Central Business (C-1), based on the following findings:
1. The City's Comprehensive Plan identifies the subject parcels as commercial/industrial.
Rezoning the property central business would be in compliance with the land use guide
plan.
2. The proposed zoning classification is appropriate for the property because there is not
topographic, environmental, or cultural limitation of the site.
3. Sewer and water are available on the property. In addition, a traffic signal and intersection
improvements have been installed at the intersection of 140th and Highway 6. At the time
of site plan approval additional public improvements may be considered to approve the
development.
4. While the properties to the east are developed with single family homes, they are
separated from this property by a drainage way that will serve as an acceptable transition
to a proposed commercial development. The rezoning would not have unreasonable
negative impact on the adjacent properties.
ADOPTED by the City Council on May 19, 2008
ATTEST:
Michele Lindau, City Clerk
LM4tZMvia—jFor
