RESOLUTION 200842 <br />APPROVING A SITE PLAN AND TAX INCREMENT FINANCING <br />AGREEMENT FOR HUGO DEVELOPMENT PARTNERS LLC IN THE <br />RESIDENTIAL SERVICE ZONING DISTRICT ON*PROPERTY LOCATED AT <br />13891 FOREST BOULEVARD NORTH <br />WHEREAS, Hugo Development Partners Inc. has requested approval of a site plan to <br />construct a retail building and a Tax Increment Financing on property located at 13891 <br />Forest Boulevard North, legally described as: <br />See Attached Legal Description <br />WHEREAS, the Planning Commission has reviewed said site plan at a duly called public <br />hearing on May 8, 2008 and recommends approval. <br />WHEREAS, the Economic Development Authority has reviewed said Tax Increment <br />Financing Agreement on September 15, 2008 and recommends approval. <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the site <br />plan and Tax Increment Financing Agreement to Development Partners Hugo LLC to <br />construct a retail building on property located at 13891 Forest Boulevard North subject to <br />the following conditions: <br />1. All trash enclosures shall be located within the building. <br />2. A fence shall be installed on the east side of the property if so deemed by <br />the City Council at a future date if a public safety issue occurs. <br />Prior to the issuance of a building permit: <br />3. An access easement shall be dedicated across the property for the benefit <br />of adjoining properties to the north and south. The easement language is <br />subject to review and approval of staff. <br />4. The Tax Increment Financing Agreement is subject to further review by <br />the City Attorney. <br />5. Building material and architecture on the north elevation of the building <br />shall be the same as the west elevation. <br />6. A driveway access permit shall be submitted and approved by Minnesota <br />Department of Transportation. <br />7. An easement shall be dedicated for right of way for the future expansion <br />of TH 61. <br />8. A building material board shall be submitted for review and approval by <br />the City. <br />
