RESOLUTION 2008-63 <br />APPROVING FINAL PLAT AND TERMINATION OF DEVELOPMENT <br />AGREEMENT FOR CROSS COUNTY PROPERTIES FOR ONEKA LAKE <br />TOWNHOMES ON PROPERTY LOCATED GENERALLY NORTH OF 150 <br />STREET AT GENERATION BOULEVARD <br />WHEREAS, Cross Country properties applied for approval of a final plat and <br />development agreement for "Oneka Lake Townhomes" to allow for the creation of 30 <br />townhome lots and one outlot on 6.7 acres, and was approved by the Hugo City Council <br />on August 7, 2006, and; <br />WHEREAS, the final plat and development agreement were properly executed and <br />recorded, and; <br />WHEREAS, the property has not developed and the required public infrastructure has not <br />been installed as required by the development agreement, and; <br />WHEREAS, Cross Country Properties has requested approval of a Final Plat for "Oneka <br />Lake Townhomes, 2nd Addition," re -platting as a single lot, the property legally described <br />as: <br />All of "Oneka Lake Townhom&' <br />WHEREAS, Cross County Properties does not intend to install the public infrastructure, <br />and further does not intend to develop the property at this time, and; <br />WHEREAS, Cross Country Properties has consented to a termination of the development <br />agreement with the City of Hugo <br />WHEREAS, Cross County Properties may propose to develop the property at a later date, <br />and; <br />WHEREAS, any later development proposal on this property is subject to approval by the <br />City Council, and may require the approval of a new development agreement. <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and herebi does approve the final <br />plat for Cross Country Properties for Oneka Lake Townhomes 2" Addition; and <br />FURTHER, that the development agreement for "Oneka Lake Townhomes" be <br />terminated. <br />
