RESOLUTION 2007- 3 <br />APPROVING FINDINGS OF FACT DENYING REQUEST FOR VARIANCES <br />FOR A DRIVEWAY LOCATED AT 6192147 STREET NORTH. <br />WHEREAS, Todd Christensen has requested variances for a driveway with no edge <br />clearance where ordinance requires five feet, and a variance to allow a 32 foot driveway <br />width were a maximum of 24 feet is allowed by ordinance on property described as <br />follows: <br />Lot 10, Block 1, Rice Lake Meadows, Washington County. <br />WHEREAS, the Board of Zoning Adjustments and Appeals has reviewed the variance <br />request at a duly called public meeting and recommended denial, and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does deny the variances <br />as requested by Todd Christensen on property located at 6192 147d' Street North based on <br />the following findings: <br />1. The applicant has not identified a unique hardship that would warrant the granting <br />of the requested variances. <br />2. The strict enforcement of the ordinance would not cause undue hardship because <br />the applicant would be able to access the garage and park cars on a driveway <br />meeting ordinance requirements. <br />3. The applicant's desire to increase the driveway is a self-created hardship and is <br />not unique to this individual parcel. <br />4. The spirit and intent of the ordinance would not be met because the driveway <br />would increase the impervious surface and reduce the amount of open space <br />intended by the ordinance. <br />5.
