RESOLUTION 20074 <br />APPROVING FINAL PLAT AND DEVELOPMENT AGREEMENT FOR POA- <br />SCHERER, LLC. FOR VICTOR GARDENS EAST 3RD ADDITION ON <br />PROPERTY LOCATED GENERALLY SOUTH OF GARDEN WAY AND EAST <br />AND WEST OF VAL JEAN BOULEVARD <br />WHEREAS, POA -Scherer, LLC. has requested approval of a Final Plat and Development <br />Agreement for "Victor Gardens East 3`d Addition" to allow the creation of 3 single family <br />home lots and 1 outlot on the 24.83 -acre property legally described as follows: <br />Outlot C, Victor Gardens East, according to the recorded plat thereof, said <br />Washington County, Minnesota. <br />WHEREAS, the City has prepared a development agreement covering the improvements <br />related to said plat; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the final <br />plat for POA -Scherer, LLC for Victor Gardens East 3'd Addition; and <br />FURTHER, that the development agreement for said final plat be approved, and that the <br />Mayor and City Administrator be authorized to execute the development agreement on <br />behalf of the City; subject to the following findings and conditions: <br />1. A final plat is approved to allow the creation of 3 single family home lots and 1 <br />outlot on the 24.83 -acre property in accordance with the plans and application <br />received by the City on December 11, 2006, except as amended by this resolution. <br />2. Approval is contingent upon the City Council approval of the vacation of the <br />existing Drainage and Utility Easement over Outlot C, Victor Gardens East. <br />3. The development is subject to the Victor Gardens PUD Concept approvals (Res. <br />2000-47). <br />4. Park dedication requirements for this site have been met with previous additions. <br />No additional park dedication is required for this phase. <br />FURTHER, that the following conditions be met prior to recording the final plat: <br />5. The applicant shall comply with all the conditions of the City Engineer's memo <br />dated December 29, 2006. <br />6. The applicant shall submit an area plat for the proposed development showing the <br />total area of the lots and the total area of right-of-way. This information is needed <br />in order to calculate the fees and charges for the Development Agreement. <br />
