RESOLUTION 2007-12 <br />APPROVING FINAL PLAT AND DEVELOPMENT AGREEMENT FOR JIM <br />KELLISON, FOR "KELLISON ADDITION" FOR THE PROPERTY LOCATED <br />AT THE NORTHEAST CORNER OF 129TH STREET NORTH AND ELMCREST <br />AVENUE <br />WHEREAS, Jim Kellison has requested approval of Final Plat to allow for the division of <br />a 4.9 acre parcel into 3 lots on property legally described as follows: <br />See Attached <br />WHEREAS, the City has prepared a development agreement covering the improvements <br />related to said plat; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the final <br />plat for Jim Kellison for Kellison Addition; and <br />FURTHER, that the development agreement for said final plat be approved, and that the <br />Mayor and City Administrator be authorized to execute the development agreement on <br />behalf of the City; and <br />FURTHER, that the following conditions be met prior to recording the final plat: <br />1. A final plat is approved in accordance with the plans received by the City on <br />April 11, 2007, except as amended by this resolution. <br />2. Development standards shall be according to preliminary plat approvals granted <br />by the City Council on October 2, 2006, and as may be amended. <br />3. Park Dedication shall be cash -in -lieu ($4,800) and must be paid. <br />4. The development agreement must be executed by the developer and the city. <br />5. The applicant must obtain all necessary wetland permits from the City of Hugo. <br />6. The road easements for 129th Street and Elmcrest Avenue shall be dedicated to <br />the City of Hugo and documents must be recorded with Washington County. <br />7. The plans must comply with the City Engineer's comments dated April 11, 2007 <br />FURTHER, that the following conditions be met prior to issuance of building permits: <br />1. Sewer and water shall be available and operable to the site as part of the 129th <br />Street Utility Project. <br />
