RESOLUTION 2007-12 APPROVING FINAL PLAT AND DEVELOPMENT AGREEMENT FOR JIM KELLISON, FOR "KELLISON ADDITION" FOR THE PROPERTY LOCATED AT THE NORTHEAST CORNER OF 129TH STREET NORTH AND ELMCREST AVENUE WHEREAS, Jim Kellison has requested approval of Final Plat to allow for the division of a 4.9 acre parcel into 3 lots on property legally described as follows: See Attached WHEREAS, the City has prepared a development agreement covering the improvements related to said plat; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the final plat for Jim Kellison for Kellison Addition; and FURTHER, that the development agreement for said final plat be approved, and that the Mayor and City Administrator be authorized to execute the development agreement on behalf of the City; and FURTHER, that the following conditions be met prior to recording the final plat: 1. A final plat is approved in accordance with the plans received by the City on April 11, 2007, except as amended by this resolution. 2. Development standards shall be according to preliminary plat approvals granted by the City Council on October 2, 2006, and as may be amended. 3. Park Dedication shall be cash -in -lieu ($4,800) and must be paid. 4. The development agreement must be executed by the developer and the city. 5. The applicant must obtain all necessary wetland permits from the City of Hugo. 6. The road easements for 129th Street and Elmcrest Avenue shall be dedicated to the City of Hugo and documents must be recorded with Washington County. 7. The plans must comply with the City Engineer's comments dated April 11, 2007 FURTHER, that the following conditions be met prior to issuance of building permits: 1. Sewer and water shall be available and operable to the site as part of the 129th Street Utility Project.
