"We The People" — Save Hugo. com <br />RESOLUTION 2007-15 <br />A RESOLUTION ESTABLISHING AND CLARIFYING CITY POLICY ON THE <br />USE OF INVOLUNTARY EMINENT DOMAIN IN THE PROPOSED TAX <br />INCREMENT FINANCING DISTRICT DESCRIBED IN THE PUBLIC HEARING <br />NOTICE PUBLISHED IN THE OFFICIAL NEWSPAPER OF THE CITY ON <br />APRIL 2, 2007 <br />WHEREAS, Council members have stated at public meetings they have no <br />intention of initiating eminent domain proceedings to take private property in the proposed <br />TIF District; <br />WHEREAS, City correspondence received by residents and property owners asked <br />to permit voluntary property inspections indicates condemnation will not be used to acquire <br />their property; <br />WHEREAS, the members of the City Council have stated at public meetings that <br />private property acquisition in the proposed TIF District should be between willing sellers <br />and willing buyers; <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />HUGO, WASHINGTON COUNTY, MINNESOTA, that the Hugo City Council, <br />notwithstanding private property needed for public roadway or public utility infrastructure <br />that will remain under fee ownership of the City of Hugo, will not initiate any involuntary <br />eminent domain procedure in the proposed TIF District; <br />AND BE FURTHER RESOLVED, the City Council directs this resolution be published in <br />its official newspaper and provided to any prospective purchaser of TIF or General <br />Obligation Bonds. <br />Upon Roll Call, following members voting AYE: Mike Granger, Frank Puleo, Fran Miron <br />Voting NAY: NONE <br />Whereupon said resolution was declared passed and adopted this 16th day of April 2007. <br />r <br />44n Mayor <br />KV9W-1111 <br />Mary Creager, City Cl <br />
