RESOLUTION 2007 - 37 <br />APPROVING A VARIANCE FROM A SIDE YARD SETBACK FOR A GARAGE <br />ADDITION FOR JAMES AND LAURIE STODOLA FOR THE PROPERTY <br />LOCATED AT 12757 HOMESTEAD DRIVE NORTH <br />WHEREAS, James and Laurie Stodola has requested a variance to locate a garage <br />addition two feet and three inches from the side property line where twenty feet is <br />required by ordinance on property described as follows: <br />Lot 10, Block 1, Royal Haven Estates <br />WHEREAS, the Board of Zoning Adjustments and Appeals has reviewed the variance at <br />a duly called public meeting and recommended approval, and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />variance request to James and Laurie Stodola has requested a variance to locate a garage <br />addition two feet and three inches from the side property line where twenty feet is <br />required by ordinance based on the following findings: <br />1. The requested variance is from the dimensional requirement of the ordinance and <br />is permissible by law. <br />2. The strict enforcement of the ordinance would cause undue hardship because of <br />circumstances unique to the individual property not caused by the land owner. <br />3. The granting of the variance would be in keeping with the spirit and intent of the <br />ordinance. <br />4. The property can not be put to reasonable use without the granting of the <br />variance. <br />5. The proposed variance is minor in nature and would not noticeably alter the <br />character to the average person. <br />6. 1,000 square foot garages are a permitted use in the RR District. <br />7. The subject property is not within a floodplain. <br />8.
