RESOLUTION 2007 - 40 <br />APPROVING A VARIANCE FOR MULTIFEEDER TECHNOLOGY IN THE <br />GENERAL INDUSTRIAL ZONING DISTRICT ON PROPERTY LOCATED AT <br />LOT 3, BLOCK 19, BALD EAGLE INDUSTRIAL PARK 4TH ADDITION <br />WHEREAS, Neal Nordling has requested approval of a variance for two future buildings <br />to be 10 feet from the side yard setback where the ordinance requires the buildings to be <br />set back at a distance that is at least equal to the height of the building, and in no case less <br />than 10 feet. <br />Lot 3, Block 1, Bald Eagle Industrial Park 4th Addition <br />WHEREAS, the Planning Commission has reviewed said variance at a duly called public <br />hearing on July 26, 2007. <br />WHEREAS, Neal Nordling agreed with the City Council recommendation. <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />variance request to Neal Nordling to permit constriction of two future buildings to be 15 <br />feet from the north side yard setback and 10 feet from the south side yard setback where <br />the ordinance requires the buildings to be set back at a distance that is at least equal to the <br />height of the building, and in no case less than 10 feet with the condition that the <br />buildings shall not exceed 30 feet in height based on the following findings: <br />1. The requested variance is permissible by law. <br />2. The strict enforcement of the ordinance would cause undue hardship <br />because of circumstances unique to the individual property not caused by <br />the land owner. <br />3. The granting of the variance would be in keeping with the spirit and intent <br />of the ordinance. <br />4. The property can not be put to reasonable use without the granting of the <br />variance. <br />5. The variance would not alter the essential character of the locality in <br />which it would be located. <br />6. The use is permitted in the zoning district. <br />7. The subject property is not within a floodplain. <br />8. Sewage and water systems will be installed in compliance with state code. <br />
