RESOLUTION 200747 <br />APPROVING A MODIFICATION TO A SPECIAL USE PERMIT FOR THE <br />OPERATION OF A SHOOTING RANGE AT 6557125 ST NORTH AND <br />ENCOURAGING CONTINUED RESPONSIBLE OPERATION OF THE <br />SHOOTING RANGE <br />WHEREAS, the Governor signed into law on May 25, 2005, the Shooting Range <br />Protection Act, limiting the City's authority to regulate certain activities at the club, and; <br />WHEREAS, the law includes provisions requiring the Minnesota DNR to promulgate <br />regulations for the proper operation of shooting ranges, but the law includes no <br />specifically stated provisions regarding enforcement of the regulations <br />WHEREAS, The City has received an application from the Bald Eagle Sportsman's <br />Association (BESA) to amend the existing Special Use Permit concerning the operation <br />of the shooting range and; <br />WHEREAS, the application is for the purpose of reconciling the Special Use Permit with <br />the recently revised state statute and; <br />WHEREAS, the Planning Commission reviewed the application at a public hearing on <br />June 14, 2007 and recommended approval, and <br />WHEREAS, the City is desirous of bringing the Conditional Use Permit into conformity <br />with the statute, while encouraging it to make improvements that will reduce the noise <br />impacts from the shooting range and will allow it to operate in greater harmony with the <br />neighborhood. <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA; <br />1. That it should and hereby does approve the amended special use permit subject to <br />the conditions included therein and subject to the provision that the conditional <br />use permit may be modified to incorporate any restriction permissible under any <br />later amendment to the statute. <br />2. That the City will contact the League of Minnesota Cities and will lobby the State <br />Legislature to establish enforcement procedures for the proper operation of <br />shooting ranges with enforcement occurring by the DNR. <br />3. That the City will continue to assist and encourage BESA with its efforts to install <br />additional sound mitigation measures on the property such as the construction of <br />enclosures around the shooting ranges. <br />4. That the City will cooperate with and support BESA to identify sources of grants <br />and other funding measures resulting in the construction of any sound mitigation <br />measures. <br />
