RESOLUTION 2007-66 <br />A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF HUGO, <br />WASHINGTON COUNTY, MINNESOTA, CONCERNING THE PAUL HUGO <br />FARMS WMA MANAGEMENT PLAN <br />WHEREAS, The City has entered into a Memorandum of Agreement (MOA) with the <br />Minnesota Department of Natural Resources (DNR) and the Rice Creek Watershed <br />District (RCWD) dated November 3, 2006; <br />WHEREAS, the MOA includes eight items concerning the management and maintenance <br />of Judicial Ditch No. 2, Rice Lake, and the Paul Hugo Farms Wildlife Management Area <br />(WMA) and invites all parties to work cooperatively as decisions are made regarding the <br />management of these areas; <br />WHEREAS, the MOA requires the DNR to prepare a management plan for land within <br />the boundaries of the existing WMA, which has now been completed with input from the <br />RCWD and the City; <br />WHEREAS, the management plan details a proposal about how property will be <br />managed within the WMA, and also allows for acquisition of certain land or easements <br />outside of the WMA from willing sellers of land or easements. <br />WHEREAS, the management plan proposes a "project boundary" which extends beyond <br />the limits of the existing WMA or any other DNR owned land; <br />WHERAS, the "project boundary" includes the area where the DNR proposes to offer <br />non-binding comment into land use decisions that are made by the City. <br />WHEREAS, the proposed "project boundary" gives the DNR no additional zoning, <br />regulatory or review authority or other rights related to land use decisions that are made <br />solely by the City. <br />WHEREAS, the City will adopt its comprehensive plan in the spring of 2008 that will <br />guide land use in the entire City, including land surrounding the WMA and the proposed <br />project boundary. <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does express support <br />the Draft of the Paul Hugo Farms WMA Management Plan Document dated December 7, <br />2007, subject to the following conditions: <br />1. The management plan in no way provides or assumes the DNR any additional <br />authority to regulate land use, development, zoning or subdivision of land within <br />any of the areas included in the management plan, other than what has been <br />granted to DNR by the state legislature through state statute. <br />
