RESOLUTION 2006-11 <br />APPROVING FINAL PLAT AND DEVELOPMENT AGREEMENT FOR PULTE <br />HOMES FOR WATERS EDGE FOURTH ADDITION <br />WHEREAS, Pulte Homes has requested approval of a Final Plat for "Waters Edge Fourth <br />Addition" on property legally described as follows: <br />Outlot A, Waters Edge Fourth Addition, Washington County, Minnesota <br />according to the recorded plat thereof <br />WHEREAS, the City has prepared a development agreement covering the improvements <br />related to said plat; <br />-NOW, THEREFORE, BE TT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the final <br />plat for Pulte Homes for Waters Edge Fourth Addition; and <br />FURTHER, that the development agreement for said final plat be approved, and that the <br />Mayor and City Administrator be authorized to execute the development agreement on <br />behalf of the City; and <br />FURTHER, that the following conditions be met prior to recording the final plat: <br />1. A final plat is approved to allow the construction of 120 Village townhome units, <br />in accordance with the plans received by the City on February 9, 2006 and <br />revisions received on March 3, 2006, except as amended by this resolution. <br />2. The development agreement must be executed by the developer and the City prior <br />to release of the final plat. <br />3. Development standards shall be according to the preliminary approvals granted by <br />the City Council on December 16, 2002 (Resolution 2002-65, 2002-66 and 2002-67) <br />and as amended on December 15, 2003 (Resolution 2003-65). <br />4. The townhomes shall be subject to the architectural controls that were created for <br />the development and previously approved by the City. Materials and colors of the <br />townhomes shall be consistent with the architectural plans and design palette <br />required as part of the PUD approval. <br />5. HOA documents or written confirmation that the townhomes will be covered <br />under the HOA established for the previous phases of this development must be <br />submitted to the City Attorney for review and approval. <br />6. Cross access and maintenance agreements as well as drainage and utility <br />easements shall be recorded with the final plat for all private drives. <br />7. Park dedication requirements were fulfilled with the first phase of this <br />development when the park land was dedicated to the City. No additional <br />dedication is due with this phase. <br />
