RESOLUTION 2006-16 <br />APPROVING PRELIMINARY PLAT FOR POA-SCHERER, LLC FOR <br />"VICTOR GARDENS 6m ADDITION" <br />WHEREAS, POA -Scherer, LLC. has requested approval of a Preliminary Plat to allow <br />construction of 60 single-family units on property legally described as follows: <br />Outlot E, Victor Gardens East. <br />WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called <br />Public Hearing and recommends approval, and; <br />NOW, THEREFORE, BE TT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />request by POA -Scherer, LLC. for a preliminary plat, subject to the following conditions: <br />1. A preliminary plat is approved to allow the creation of 60 single-family units and 6 <br />outlots on 44.23 acres, in accordance with the plans and application received by the <br />City on January 12, 2006 and February 13, 2006, except as amended by this <br />resolution. <br />2. Approval is contingent upon City Council approval of the PUD Amendment. <br />3. Development standards shall be as approved as part of the PUD. <br />4. The applicant shall comply with all conditions of PUD concept plan approval <br />(Resolution #2000-47) and the original development agreement dated June 6, 2002. <br />5. Prior to issuance of building permits, the applicant shall submit a Final Plat for <br />review and approval by the City. <br />6. Prior to issuance of building permits, the applicant shall file the Final Plat at <br />Washington County. <br />7. The vacation of the existing drainage and utility easement over Outlot E must be <br />approved before filing the final plat. <br />8. The plans must be revised to provide a drainage and utility easement over the <br />wetlands and stormwater ponds in Oudots C through F. <br />9. Outlots C through F must be owned and maintained by the Homeowners Association. <br />10. The plans must be revised to include a trail detail. The trail must be constructed from <br />bituminous material. <br />
