RESOLUTION 2006 - 28 <br />APPROVING PRELIMINARY PLAT FOR POA-SCHERER, LLC FOR <br />"VICTOR GARDENS 5m ADDITION" <br />WHEREAS, POA -Scherer, LLC. has requested approval of a Preliminary Plat to allow <br />construction of 7 townhome units on property legally described as follows: <br />Oudot B, Victor Gardens 2nd Addition. <br />WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called <br />Public Hearing and recommends approval, and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />request by POA -Scherer, LLC. for a preliminary plat, subject to the following conditions: <br />1. A preliminary plat is approved to allow the creation of 7 townhome units on 2 condo <br />lots, 1 lot for the pool/community center and 1 outlot, in accordance with the plans <br />and application received by the City on December 12, 2005 and February 2, 2006, <br />except as amended by this resolution. <br />2. Approval is contingent upon City Council approval of the PUD Amendment. <br />3. Development standards shall be as approved as part of the PUD. <br />4. The applicant shall comply with all conditions of PUD concept plan approval <br />(Resolution #2000-47). <br />5. Prior to issuance of building permits, the applicant shall submit a Final Plat for <br />review and approval by the City. <br />6. Prior to issuance of building permits, the applicant shall file the Final Plat at <br />Washington County. <br />7. The vacation of the existing drainage and utility easement over Outlot B must be <br />approved before filing the final plat. <br />8. The plans must be revised to provide a drainage and utility easement over the <br />wetlands in Outlot A. <br />9. The plans must be revised to dedicate a 10 -foot drainage and utility easement along <br />the right-of-way of Victor Hugo Boulevard and Victor Path. <br />10. The applicant must comply with all conditions outlined in the City Engineer's memo, <br />dated February 16, 2006. <br />
