RESOLUTION 2006 - 28 APPROVING PRELIMINARY PLAT FOR POA-SCHERER, LLC FOR "VICTOR GARDENS 5m ADDITION" WHEREAS, POA -Scherer, LLC. has requested approval of a Preliminary Plat to allow construction of 7 townhome units on property legally described as follows: Oudot B, Victor Gardens 2nd Addition. WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called Public Hearing and recommends approval, and; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the request by POA -Scherer, LLC. for a preliminary plat, subject to the following conditions: 1. A preliminary plat is approved to allow the creation of 7 townhome units on 2 condo lots, 1 lot for the pool/community center and 1 outlot, in accordance with the plans and application received by the City on December 12, 2005 and February 2, 2006, except as amended by this resolution. 2. Approval is contingent upon City Council approval of the PUD Amendment. 3. Development standards shall be as approved as part of the PUD. 4. The applicant shall comply with all conditions of PUD concept plan approval (Resolution #2000-47). 5. Prior to issuance of building permits, the applicant shall submit a Final Plat for review and approval by the City. 6. Prior to issuance of building permits, the applicant shall file the Final Plat at Washington County. 7. The vacation of the existing drainage and utility easement over Outlot B must be approved before filing the final plat. 8. The plans must be revised to provide a drainage and utility easement over the wetlands in Outlot A. 9. The plans must be revised to dedicate a 10 -foot drainage and utility easement along the right-of-way of Victor Hugo Boulevard and Victor Path. 10. The applicant must comply with all conditions outlined in the City Engineer's memo, dated February 16, 2006.
