RESOLUTION 2006-39 <br />APPROVING FINAL PLAT AND DEVELOPMENT AGREEMENT FOR ONEKA <br />LAKE TOWNHOMES LLC FOR ONEKA LAKE TOWNHOMES <br />ON PROPERTY LOCATED NORTH OF 150' STREET AND EAST OF <br />HIGHWAY 61 <br />WHEREAS, Oneka Lake Townhomes LLC has requested approval of a final plat to <br />allow 30 twnhomes and one outlot on the property legally described as follows: <br />The West One-third of the South Half of the Southeast Quarter of the Southeast <br />Quarter of Section 17, Township 31, Range 21, Washington County. <br />WHEREAS, the City has prepared a development agreement covering the improvements <br />related to said plat; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the final <br />plat for Oneka Lake Townhomes LLC for Oneka Lake Townhomes; and <br />FURTHER, that the development agreement for said final plat be approved, and that the <br />Mayor and City Administrator be authorized to execute the development agreement on <br />behalf of the City; subject to the following conditions: <br />1. A final plat is approved to allow the construction of 30 multi -family units, in <br />accordance with the approved preliminary plat February 21, 2006 and the plans <br />received by the City on June 1, 2006 and revised on June 6, 2006 and June 26, 2006 <br />except as amended by this resolution. <br />2. The Final Plat shall be subject to the Preliminary Plat approval granted by the City <br />Council on February 21, 2006 and as may be amended. (Resolution # 2006-04). <br />3. The development agreement must be executed by the developer and the City prior to <br />release of the final plat. <br />4. The applicant shall comply with all conditions in the City Engineer's letter dated July <br />28, 2006. <br />5. Prior to release of the final plat and resolution for filing at Washington County, the <br />applicant must comply with the following conditions: <br />a. The applicant must pay park dedication fees for the 30 units, subject to the park <br />dedication requirements in place at the time of filing the final plat. <br />b. The common interest community documents shall be submitted for review and <br />approval by the City Attorney. <br />
