RESOLUTION 2006-50 <br />APPROVING A PUD AMENDMENT FOR POSITIVE COMPANIES, INC. FOR <br />"VICTOR GARDENS SOUTH VILLAGE" ON PROPERTY LOCATED SOUTH <br />OF FRENCHMAN ROAD (COUNTY ROAD 8) AND EAST OF VICTOR HUGO <br />BOULEVARD <br />WHEREAS, Positive Companies, Inc. has requested approval of a PUD Amendment for <br />the 20,109 square foot retail building on the property legally described as follows: <br />Lot 7, Block 1, Victor Gardens South <br />WHEREAS, the Planning Commission has reviewed the PUD Amendment and <br />recommends approval, and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />request by Positive Companies, Inc. for a PUD amendment, subject to the following <br />conditions: <br />1. A PUD Amendment is approved for a 20,109 -square foot retail building, in <br />accordance with the plans received on July 25, 2006, except as amended by this <br />resolution. <br />2. PUD flexibility is granted allow the changes shown on the July 25, 2006 plans, except <br />as amended by this resolution. <br />3. The development shall be subject to the conditions of the July 6, 2006 PUD and <br />preliminary plat approvals (Resolution 2006-50 and 2006-51) and the September 7, <br />2004 final plat approval (Resolution 2006-68), except as amended by this resolution. <br />4. Building materials shall be as shown on the plans. The material samples shall be <br />submitted for City review and approval prior to issuance of building permits. <br />5. Staff will monitor the tenants within the development to ensure that adequate parking <br />is provided as tenants are finalized. <br />6. PUD flexibility shall be granted to allow a 24 -foot setback on CSAH 8 only if the end <br />cap is wrapped with glass. The west elevation must be wrapped with glass along at <br />least one bay. The plans must be revised prior to issuance of building permits. <br />7. Glass is provided on street elevations as shown on the plans. Where possible, the <br />City encourages these doors to be used as customer entrances to the businesses. <br />8. Prior to issuance of building permits, the following items must be addressed: <br />
