RESOLUTION 2006-64 <br />APPROVING FINDINGS OF FACT DENYING VARIANCE TO FOR A SIDE <br />YARD SETBACK FOR A GARAGE ADDITION AT 6061144" STREET NORTH <br />WHEREAS, Jason Schwieger has requested a variance to locate a garage six feet from <br />the side property line where ten feet is required by ordinance on property described as <br />follows: <br />Lot 6, Block 2, Rice Lake Meadows Third Addition, Washington County. <br />WHEREAS, the Board of Zoning Adjustments and Appeals has reviewed the variance at <br />a duly called public meeting and recommended denial, and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does deny the variance <br />requested by Jason Schwieger for property located at 6061 140 Street North based on <br />the following findings: <br />1. The applicant has not identified a unique hardship that would warrant the granting <br />of the requested variances. <br />2. The strict enforcement of the ordinance would not cause undue hardship because <br />the applicant has a garage of reasonable size. <br />3. The applicant's desire to increase the garage is a self-created hardship and is not <br />unique to this individual parcel. <br />4. The spirit and intent of the ordinance would not be met because the proposed <br />garage would extend four feet into the required setback, reducing the amount of <br />open space intended by the ordinance. <br />5.
