RESOLUTION 2006-68 <br />APPROVING FINDINGS OF FACT DENYING REQUEST TO VACATE THE <br />DRAINAGE AND UTILITY EASEMENT OVER PROPERTY LOCATED AT <br />14189 FINALE AVENUE NORTH. <br />WHEREAS, Alice Waller has requested the vacation of the drainage and utility easement <br />located on her property described as follows: <br />Lot 15, Block 3, Oneka Estates, Washington County. <br />WHEREAS, the City Council has reviewed the vacation request at a duly called public <br />meeting, and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does deny the vacation <br />of the drainage and utility easement requested by Alice Waller on property located at <br />14189 Finale Avenue North based on the following findings: <br />1. The easement was created to include property located within 100 feet from the <br />centerline of Clearwater Creek according to Rule E of the Rice Creek Watershed <br />District. <br />2. The easement is necessary for flood control and protection of water quality. <br />3. The applicant would like to construct a chain-link fence within the drainage and <br />utility easement. <br />4. Fences that do not obstruct drainage are permitted within drainage and utility <br />easements <br />5. The applicant has not demonstrated a need for the vacation of the drainage and <br />utility easement. <br />ADOPTED by the City Council this 0 day of December <br />on, Mayor <br />ATTEST: <br />Mary reager, City Clerk <br />r <br />
