RESOLUTION 2005-6 <br />APPROVING PRELIMINARY PLAT FOR POA-SCHERER, LLC. FOR "VICTOR <br />GARDENS NORTH" ON PROPERTY LOCATED NORTH OF FRENCHMAN ROAD <br />(COUNTY ROAD 8) AND EAST OF ELMCREST AVENUE NORTH <br />WHEREAS, POA -Scherer, LLC. has requested approval of a preliminary plat to allow construction <br />of 186 townhome units, 1 commercial lot and 2 outlots on the 46.43 -acre property legally described <br />as follows: <br />Outlot A, Victor Gardens, Washington County, Minnesota. <br />WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called Public <br />Hearing and recommends approval; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />HUGO, MINNESOTA, that it should and hereby does approve the request by POA-SCHERER, <br />LLC for a preliminary plat, subject to the following conditions: <br />1. A preliminary plat is approved to allow the creation of 186 townhomes, 1 commercial lot and 2 <br />outlots in accordance with the plans received by the City on January 24, 2005 and revisions <br />received on January 25, 2005, except as amended by this resolution. <br />2. Approval is contingent upon the City Council approval of the requested PUD general plan. <br />3. Development standards shall be as approved as part of the PUD. <br />4. Park dedication requirements for this site have been met with previous additions. No additional <br />park dedication is required for this phase. <br />5. The developer must obtain all necessary permits from the City. <br />6. The development shall comply with the Fire Chiefs requirements regarding fire flow <br />calculations, the location of fire hydrants, fire department connections, and fire lane signage. <br />7. The developer must comply with all conditions outlined in the City Engineer's memo dated <br />February 2, 2005. <br />8. The developer must obtain preliminary plat approval from Washington County and comply will <br />all conditions of plat approval. <br />Adopted by the Hugo City Council this 2fd day of February 2005. <br />on, Mayor <br />ATTEST: <br />Mary Creager, City C <br />
