RESOLUTION 2005-16 <br />APPROVING FINAL PLAT AND DEVELOPMENT AGREEMENT FOR PULTE <br />HOMES FOR WATERS EDGE SOUTH SECOND ADDITION <br />WHEREAS, Pulte Homes has requested approval of a Final Plat for "Waters Edge South <br />Second Addition" on property legally described as follows: <br />Outlot A and Outlot D, Waters Edge South, Washington County, Minnesota <br />according to the recorded plat thereof <br />WHEREAS, the City has prepared a development agreement covering the improvements <br />related to said plat; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the final <br />plat for Pulte Homes for Waters Edge South Second Addition; and <br />FURTHER, that the development agreement for said final plat be approved, and that the <br />Mayor and City Administrator be authorized to execute the development agreement on <br />behalf of the City; and <br />FURTHER, that the following conditions be met prior to recording the final plat: <br />1. A final plat is approved to allow the construction of 213 townhome units, in <br />accordance with the plans received by the City on January 28, 2005 and revisions <br />received on February 25, 2005, except as amended by this resolution. <br />2. The development agreement must be executed by the developer and the City prior <br />to release of the final plat. <br />3. Development standards shall be according to the PUD general plan and <br />preliminary plat approvals granted by the City Council on December 15, 2003, <br />and as may be amended. <br />4. The townwhomes shall be subject to the architectural controls that were created <br />for the development and previously approved by the City. Materials and colors of <br />the townhomes shall be consistent with the architectural plans and design palette <br />required as part of the PUD approval. <br />5. Proof that the townhomes will be covered under the HOA established for the <br />previous phases of this development. <br />6. Cross access and maintenance agreements as well as drainage and utility <br />easements shall be recorded with the final plat for all private drives. <br />7. The landscape plans shall include details for the proposed fence along the west <br />property line. The location of the fence shall be clearly defined on the plans. <br />
