Resolution 2005-35 <br />Page 2 <br />4. The following conditions must be met prior to recording the final plat: <br />a. The development agreement must be executed by the developer and the City <br />prior to release of the final plat. <br />b. The developer shall pay the park dedication fees in lieu of land dedication, <br />pursuant to the Dedication Policy in effect at the time of recording the final <br />plat. <br />c. The developer must provide a trail easement over any portion of the trail that <br />is located on the subject property. A copy of the trail easement must be <br />submitted for review and approval by the City Attorney prior to recording at <br />Hennepin County. <br />5. The following conditions must be met prior to issuance of building permits: <br />a. The developer shall comply with all conditions in the City Engineer's <br />Memo dated May 5, 2005. <br />b. The homeowner association documents must be recorded at Washington <br />County with the final plat. <br />c. Cross access and maintenance agreements shall be recorded with the final <br />plat for all shared private driveways or streets. <br />d.
