11 <br />RESOLUTION 2004-05 <br />APPROVING PRELIlVIINARY PLAT FOR MASTERPIECE HOMES, INC. FOR <br />"NORTHERN PINES" ON PROPERTY LOCATED AT THE NORTHEAST <br />QUADRANT OF HIGHWAY 61 AND 125m STREET <br />WHEREAS, Masterpiece Homes, Inc. has requested approval of a preliminary plat to <br />allow construction of 38 homes on the 12.3 -acre property legally described as follows: <br />All that part of the southeast quarter of the northeast quarter of Section 31, <br />Township 31 north, Range 21 west of the fourth principal meridian, lying <br />east of the east line of Lake Superior and Mississippi Railroad Company's, <br />a corporation, right-of-way as described in that certain Document of <br />Record dated February 12, 1874, recorded April 24, 1878 in the Book of <br />Deeds Number Three (3) at page one hundred and seventy-three (173) and <br />filed in the office of the County Recorder of Washington County in the <br />State of Minnesota <br />Except that part taken for U.S. Highway No. 61. <br />WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called <br />Public Hearing and recommends approval, and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE. CITY .COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />request by Masterpiece Homes, Inc. for a preliminary plat, subject to the following <br />conditions: <br />1. A preliminary plat is approved to allow the creation of 38 twinhome lots and two <br />common lots, in accordance with the plans and application received by the City on <br />November 26, 2003, except as amended by this resolution. <br />2. Approval is contingent upon City Council approval of the rezoning from R-3 to PUD. <br />3. Development standards shall be as approved as part of the PUD. <br />4. The park dedication shall be cash -in -lieu of dedication and shall be due prior to filing <br />the final plat. <br />5. The applicant shall provide copies of the HOA documentstcovenants for City review. <br />A copy of the covenants shall be filed with the final plat. <br />6. A master sign plan for the development shall be submitted for City review and <br />approval. <br />7. The right-of-way for public streets shall be 50 feet. <br />
