RESOLUTION 2004-6 <br />APPROVING FINDINGS OF FACT FOR REZONING FROM AGRICULTURAL <br />TO LONG TERM AGRICULTURAL AND CERTIFYING PROPERTY <br />ELIGIBLE FOR DESIGNATION AS AGRICULTURAL PRESERVE FOR <br />PROPERTY LOCATED NORTH OF COUNTY ROAD 57 AND WEST OF <br />KEYSTONE AVENUE NORTH <br />WHEREAS, Charles and MaryKay Haas have requested reclassification of the zoning <br />from Agricultural to Long Term Agricultural for an 80 -acre parcel, legally described as <br />follows: <br />The East % of the Northeast V4, Section 13, T31N-R21W, Washington County, <br />Minnesota. <br />WHEREAS, the Planning Commission has reviewed the rezoning at a duly called Public <br />Hearing and recommends approval of the rezoning, and; <br />WHEREAS, the Planning Commission finds that the property should be certified eligible <br />for designation as agricultural preserve, and; <br />WHEREAS, the City Council has adopted an ordinance rezoning the affected parcel from <br />Agricultural to Long Term Agricultural; and <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL, OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does certify the <br />property eligible for designation as agricultural preserve and approves the reclassification <br />of the zoning from Agricultural to Long Term Agricultural, based on the following <br />findings: <br />1. The proposed rezoning is consistent with the Comprehensive Plan and other City <br />policies and plans, because the rezoning would help preserve agricultural land in an <br />area of the City designated as permanent rural. <br />2. The property is eligible for inclusion in the Metropolitan Agricultural Preserves <br />program as outline in Section 473H of the State Statutes. <br />3. The property contains a single family home, agriculture land, and vacant natural <br />areas. These land uses are consistent with the proposed zoning. <br />4. The proposed development meets the intent of the Long Term Agricultural district by <br />preserving a parcel greater than 40 acres for future agricultural and open space use. <br />ADOPTED by the City Council this 17s' day of February . <br />F n, Mayor <br />l ATTEST: <br />y !� <br />Michele Lindau <br />Community Development Assistant <br />
